FUSINITE LTD TERMS AND CONDITIONS
1. Introduction
Welcome to Fusinite Ltd. These Terms and Conditions (“T&Cs”) govern your use of our services, including certification of carbon storage, carbon storage security assessments for CDR technologies, particularly biochar and biocarbon carbon removal, subscription plans, virtual consultations, and access to our online platform for tracking sample shipments, reporting, certification, and scheduling consultations. Our goal is to improve carbon storage efficiency and permanence using the latest state-of-the-art scientific knowledge. By submitting samples, accessing the platform, or using any services provided by Fusinite Ltd, you (“Client”) agree to be bound by these T&Cs.
Fusinite Ltd is a company registered in the United Kingdom, offering services to clients globally. These T&Cs apply regardless of the Client's location or the origin of submitted samples.
2. Definitions
- Fusinite Ltd (“Fusinite”): The provider online carbon storage certification and consultation services.
- Client: The individual or entity that submits biochar samples for analysis and certification or subscribes to Fusinite services.
- Certification: The report and certificate provided by Fusinite Ltd upon analysing samples based on the highest scientific standards and peer-reviewed research.
- Sample: Material or medium containing carbon storage, such as biochar, biocarbon, and soil organic carbon, submitted by the Client or third parties for analysis.
- Data: Includes personal data, company data, and metadata related to the samples, supporting reporting and client consultation.
- Third-Party Organizations: Entities that may access Fusinite’s platform to verify certifications or commission analyses.
- Carbon Credit Buyers: individuals or companies verifying the carbon storage potential of samples for trading or regulatory compliance.
- Regulators: Include governmental or independent bodies overseeing compliance with carbon standards or regulations.
3.Scope of Services
Fusinite provides:
- Certification Services: Fusinite provides Carbon Certification and Carbon Storage Security Consultation, offering certification and reporting of carbon-rich samples, particularly biochar and biocarbon, based on the latest peer-reviewed scientific analysis of carbon storage potential.
- Virtual Consultations: Fusinite offers virtual consultations to explain data analysis results, aimed at helping clients improve service efficiency, material quality, and carbon storage potential.
- Third-Party Services: Third-party services allow entities to verify certifications or request sample analyses, even without prior relationships with the producer. Third parties must follow the same submission, shipment, packaging, and pricing requirements as Clients and may become members to benefit from subscription advantages
- Subscription Plans: Fusinite offers two subscription tiers:
- Premium Membership: Premium members pay a monthly fee and receive discounts on testing services, plus a free 30-minute consultation per sample shipment.
- Free Membership: Free members pay for services on a per-test basis without subscription benefits.
Note: Fusinite does not guarantee financial value or market acceptance of certified biochar, as certifications are based solely on the scientific analysis of the samples provided.
4. Data Collection and Privacy
Fusinite collects and processes personal data, company information, and biochar sample data as necessary to deliver our services. We comply with the UK General Data Protection Regulation (GDPR) and other applicable data protection laws for Clients located in other jurisdictions.
- Fusinite collects personal information such as name, email, and address for communication and service delivery.
- Company data, such as the name and registration details, may also be collected.
- We collect metadata associated with the biochar samples submitted for analysis, including sample composition and carbon storage metrics.
- Third-party organizations may request to verify certifications or commission sample analyses. In these cases, Fusinite may need to share certain biochar-related data with these organizations for verification purposes. However, personal information (such as names, addresses, and company details) will not be shared with third-party organizations, except as required for shipping or invoicing purposes.
- For additional analysis, we may send samples to other third-party laboratories. Fusinite covers these costs, including shipping. Clients acknowledge that their samples may be sent to third parties, and some data related to the samples may be shared. These third-party laboratories may store the data for their own use.
GDPR Compliance:
- Clients have the right to:
- Access, correct, and delete personal data.
- Restrict or object to the processing of their personal data.
- Request the transfer of their data to another service provider.
Fusinite uses secure methods to store and protect data, processing data for legitimate business purposes, including service provision and certification verification.
5. Payments and Subscriptions
Clients may make payments online using major credit or debit cards through our website. Fusinite also offers the option to provide account details for bank transfers upon request. Payment is required before certification or analysis reports are issued.
Subscription Plans:
- Premium Membership: Clients pay a recurring monthly fee, automatically charged to their payment method. Subscription may be cancelled with three months’ notice. Premium members receive discounted pricing on regular sample submissions and one free 30-minute consultation per sample shipment.
- Free Membership: Free members pay per test and consultation at the rates listed on the Fusinite website.
Pricing is subject to change and is displayed on our website.
6. Sample Submission and Accuracy
Once a sample test is purchased and payment is received, Fusinite will issue unique sample tags, including a reference number and barcode, which must be applied to the corresponding samples. It is the Client’s responsibility to match the sample with the correct form and label. Fusinite has no way of verifying whether the tags are applied correctly.
Clients are also responsible for following the instructions provided on our website regarding sample packaging, weight, and condition. Clients may choose their preferred shipping method through the website, which may assist in securing a shipping process. Shipping costs are the Client’s responsibility, though Fusinite may charge for shipping and pay the shipping provider directly. Clients acknowledge that if packaging instructions are not followed, the shipping provider may reject the package, and any additional costs incurred will be the Client’s responsibility.
7. Certification
Certifications issued by Fusinite are based on the scientific analysis of biochar samples. Certifications include a sample reference code, which may be shared with third parties for verification purposes.
Gold Inertinite Certificate: Fusinite a Gold Inertinite Certificate to biochar samples that achieve an inertinite level of over 95%, recognized as the most stable form of carbon storage. This certificate is provided digitally through our secure Client Portal and can be downloaded in standard formats. The certificate is a digital card that contains sample reference(s) and can be used by third parties for verification.
Fusinite retains the right to verify the integrity of certifications if requested by third parties. However, Fusinite will ensure that personal or confidential company data is not disclosed to third parties unless necessary for verification.
Certifications are valid only for the specific samples tested. Any unauthorized use or misrepresentation of certifications will result in invalidation, and legal action may be pursued.
8. Third-Party Access and Verification
Third parties may access the Fusinite platform to verify certifications issued by Fusinite to biochar producers or submit samples for analysis. Third parties must follow the same submission, shipment, packaging, and pricing requirements as Clients. For verification purposes, Fusinite may share relevant sample-related data with third-party organizations, while taking measures to protect confidential information. Third parties may also request additional sample analysis to compare with previously certified biochar, without disclosing the identity of the producer.
9. Virtual Consultation
Fusinite offers virtual consultations where our experts explain the results of biochar analysis to Clients. Premium members receive a free 30-minute consultation per sample shipment, while free members may request consultations at the rates listed on the website.
10. Intellectual Property
Fusinite retains all intellectual property rights over scientific methods, software, reports, and certificates. Clients are granted a limited, non-transferable license to use certifications and reports as authorized, but may not reverse-engineer or exploit Fusinite’s proprietary processes.
11. Liability
Fusinite is not liable for any indirect, incidental, or consequential damages resulting from the use of our services. Our liability is limited to the direct costs of the certification services provided.
Fusinite’s total liability will not exceed the amount paid by the Client for the specific service or subscription.
12. Use of Metadata for Scientific Research
Fusinite reserves the right to use anonymized metadata from sample analyses for scientific research, publications, and educational purposes. This includes using data to study biochar’s carbon storage potential on a broader scale. Personal and company-specific data will not be used for research without explicit consent.
13. Time for Analysis
Fusinite reserves the right to take the necessary time to conduct a thorough analysis of biochar samples. While we aim to provide results within one month, Clients acknowledge that delays may occur and agree that the timeframe for completion is not guaranteed.
14. Termination
Fusinite or the Client may terminate this agreement in the event of a breach of these T&Cs. Upon termination, all certifications related to the terminated agreement will become invalid.
Fusinite may retain relevant data for record-keeping and legal compliance purposes after termination.
15. Dispute Resolution
Disputes arising under these T&Cs will be resolved amicably between the parties. If a resolution cannot be reached, the dispute may be referred to mediation or arbitration under UK law.
These T&Cs are governed by and construed in accordance with the laws of England and Wales.
16. GDPR and Data Protection
Fusinite processes personal data in compliance with GDPR. Clients have the right to request access to their data, rectify inaccuracies, and request deletion or restrictions in certain cases. Fusinite will notify Clients of any data breaches that may affect them.

17. Amendments
Fusinite reserves the right to amend these T&Cs at any time. Clients will be notified of changes, and continued use of the platform or services after such changes constitutes acceptance of the updated T&Cs.

Important Legal Statement
The carbon storage security analysis provided by Fusinite Ltd. is conducted exclusively on the submitted sample(s), which must be representative of the production batch in question. For carbon credit and certification purposes, the submitting party must declare that the sample has been collected following the guidelines of ISO 18135:2017 (or similar standards such as ASTM E877-13 or EN 14780:2017, where applicable). Fusinite.com holds no responsibility for the representativeness of the submitted sample in reflecting the characteristics of the overall production at the time and place of sampling.
Our analysis and reporting pertain solely to the submitted sample and the results are conditional upon the assumption that the sample was collected according to ISO 18135:2017 or comparable industry standards. Fusinite.com assumes no liability for inaccuracies in representativeness or potential discrepancies with other samples from the same production batch.
Additionally, by submitting the sample, the provider acknowledges and agrees to the following:
- The sample is deemed representative of the production lot or batch at the time and location of collection.
- The sample was collected and handled according to ISO 18135:2017 or a comparable standard, such as ASTM E877-13 or EN 14780:2017.
- All accessory data and information submitted alongside the sample, including batch information, sampling date, and location, are accurate and truthful to the best of the provider’s knowledge.
